- 1. Permanent, Irrevocable License Over Your Content
- By uploading or syncing anything—even drafts or clips stored in the cloud—you grant CapCut (and ByteDance) a perpetual, worldwide, royalty-free, sublicensable and transferable license to use, modify, distribute, monetize, and even resell your content without compensating you or requiring permission
- This license remains active even if you delete your account or remove content
- 2. Rights to Your Likeness, Voice & Biometric Data
- The update explicitly allows CapCut to use your name, image, voice, and biometric data (like facial recognition, voice patterns) in promotions or ads, with no compensation or approval required
- This has serious implications for privacy and identity exploitation, particularly concerning for journalists and public figures .
3. Non-Confidentiality of Uploaded Content
- All content you upload is now considered non-confidential, meaning CapCut can share it broadly, including with third parties and across ByteDance platforms (e.g. TikTok), potentially for profiling or algorithmic targeting.
4. Liability Shifts & Future Term Changes
- Users must also agree to broad liability waivers, making them responsible for their content.
- CapCut reserves the right to change pricing, plans, features, or terms at any time, and continued use is deemed consent
5. Content Use Restrictions & Monetization Risk
- Built-in assets like templates, stock footage, music, filters, and stickers are now typically restricted from commercial use unless you get a Pro license or explicit permission
